Welcome to Lumi. These Terms of Service (“Terms”) govern your use of the Lumi mobile app, the website at lumimind.app, and related services (together, the “Service”). The Service is operated by Ember Labs, LLC, a Florida limited liability company doing business as Lumi (“Lumi,” “we,” “us,” or “our”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old to use Lumi. By using the Service, you confirm that you are at least 18 and have the legal capacity to agree to these Terms.
2. What Lumi Is, and Is Not
Lumi is an AI-powered companion app designed to support adults with ADHD and other neurodivergent brains. It offers self-help tools, conversational support, mood check-ins, reminders, and task and calendar features.
Lumi is not a healthcare provider, therapist, or medical device, and it does not replace professional medical or mental health care. The Service is not intended to diagnose, treat, or prevent any disease or condition, including ADHD. Talk with a qualified clinician about any medical or psychological question.
If you are in crisis or an emergency:
Lumi is not equipped to handle emergencies. Do not rely on it for urgent or emergency support.
3. Your Account
To use Lumi you must create an account through our sign-in provider. You are responsible for giving accurate information, keeping your login details secure, and everything that happens under your account. Tell us promptly if you think someone has accessed your account without permission.
4. Subscriptions, Free Trials, and Billing
Lumi is offered through paid subscription plans (currently Core and Companion), billed monthly or annually. There is no free plan. Prices are shown in the app store before you subscribe and may change; a price change will not affect your current billing period.
Purchases go through the app store. Subscriptions are purchased and billed through the Apple App Store (and Google Play, once Lumi is available there). Payment is charged to your Apple Account (or Google account) at confirmation of purchase.
Free trial. Lumi offers a 7-day free trial on its plans. Unless you cancel at least 24 hours before the trial ends, your subscription begins and you will be charged the plan price. Any unused part of a free trial is forfeited when you purchase a subscription.
Automatic renewal. Subscriptions renew automatically at the end of each billing period unless you cancel at least 24 hours before the period ends.
Cancelling. Manage or cancel your subscription in your Apple Account settings (or Google Play subscription settings). Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current billing period.
Refunds. Apple and Google process refunds under their own policies. Except where the law requires otherwise, payments are not refundable by us.
5. Reminders and Notifications
Lumi can send reminders, such as medication reminders, calendar heads-ups, and check-ins. They are conveniences. Lumi does not give medical advice or tell you what or when to take, so follow your prescriber’s instructions. Reminders can be delayed or missed because of device settings, notification permissions, battery or connectivity issues. Do not rely on Lumi as your only way to manage medication or time-critical commitments.
6. Acceptable Use
You agree not to:
7. AI-Generated Content
Lumi uses large language models, including Claude from Anthropic, to generate responses. You understand that:
We do not guarantee that AI-generated content is accurate or appropriate for you.
8. Your Content
You keep ownership of what you submit to Lumi, including mood check-ins, brain dumps, notes, and conversations (“User Content”).
You give Ember Labs, LLC a limited, non-exclusive, worldwide, royalty-free license to use, store, process, and transmit your User Content only to provide, secure, and improve the Service. We do not sell your personal content. Our Privacy Policy explains how we handle your data, including what is shared with our AI provider.
9. Third-Party Services
The Service works with third parties, such as our AI provider, app stores, and calendar services you choose to connect (for example Google, Microsoft, or Apple calendars). Those services have their own terms and privacy policies, and we are not responsible for them. You can disconnect a calendar at any time in the app.
10. Intellectual Property
The Service, including its software, design, branding, text, graphics, and the Lumi name and logo, belongs to Ember Labs, LLC and is protected by intellectual property laws. You may not copy, reproduce, modify, or distribute Service content without our written permission. We give you a personal, limited, non-exclusive, non-transferable license to use the app for your own non-commercial use, subject to these Terms.
11. Changes to the Service
We may change, suspend, or discontinue the Service or any feature at any time, with or without notice. We are not liable for any change, suspension, or discontinuation. If we end a paid service you have already paid for, we will work with the app store to handle a fair refund.
12. Termination and Deleting Your Account
We may suspend or end your account if you break these Terms, use the Service unlawfully, or if we stop offering the Service. You can delete your account at any time in the app’s settings. When an account ends, your access ends and your User Content may be deleted after a reasonable period, as described in our Privacy Policy. Sections 7, 8, 10, 13, 14, 15, 16, and 19 survive termination.
13. Disclaimer of Warranties
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EMBER LABS, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $100. SOME LAWS DO NOT ALLOW CERTAIN LIMITS, SO THESE MAY NOT FULLY APPLY TO YOU.
15. Indemnification
To the extent the law allows, you agree to defend and hold harmless Ember Labs, LLC and its members, managers, employees, and affiliates from claims, damages, and expenses arising from your use of the Service, your User Content, or your breach of these Terms.
16. Governing Law and Disputes
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws rules.
Informal resolution first. Before filing a claim, contact us at hello@lumimind.app and give us 30 days to try to resolve it.
Arbitration. If we cannot resolve a dispute informally, it will be settled by binding arbitration under the consumer rules of the American Arbitration Association, held in Seminole County, Florida or by video, except that either of us may bring an individual claim in small claims court and either of us may seek court relief for intellectual property misuse.
No class actions. To the extent the law allows, disputes will be brought only on an individual basis, not as a class or representative action.
17. App Store Terms
Apple. If you use Lumi on an Apple device, you also agree to the following. These Terms are between you and Ember Labs, LLC, not Apple. Ember Labs, LLC, not Apple, is responsible for the app and its content. Your license is limited to use on Apple-branded devices you own or control, under Apple’s Media Services Terms. Apple has no duty to provide maintenance or support. If the app fails to meet any applicable warranty, you may tell Apple, and Apple may refund the purchase price; beyond that, Apple has no warranty obligation for the app. Ember Labs, LLC, not Apple, is responsible for product claims, legal compliance, and intellectual property claims relating to the app. You confirm that you are not located in a country under a U.S. embargo or on a U.S. list of restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Google. If you use Lumi through Google Play, Google’s terms for the store also apply, and Google is not responsible for the app or its support.
18. Changes to These Terms
We may update these Terms from time to time. For significant changes we will notify you by email or in the app. If you keep using the Service after a change takes effect, you accept the updated Terms.
19. General
These Terms, with our Privacy Policy, are the entire agreement between you and us about the Service. If any part is found unenforceable, the rest stays in effect. If we do not enforce a right, it does not mean we give it up. You may not transfer your rights under these Terms; we may transfer ours as part of a business change, such as a sale or merger.
